Nano.com Privacy Policy

1. Overview
This Privacy Policy explains how Nano collects, uses, discloses, and protects personal information across our applications, programs, and AI-assisted services, including weight-loss and personal development programs.
Nano is committed to protecting user privacy and does not sell personal information.
2. Interactions with AI and Human Support
Nano provides AI-assisted features as part of its services. Users may interact with automated systems, including third-party large language models and related AI infrastructure providers, as well as with human team members.
When users engage with AI features, user inputs, account information, and related content may be transmitted to third-party AI service providers for processing and response generation. These providers act as service providers or processors on Nano's behalf under contractual confidentiality and data protection obligations. They are not permitted to use personal information for their own independent marketing or commercial purposes.
AI-generated outputs are experimental in nature and may contain inaccuracies or errors. AI outputs are not medical, legal, or professional advice and should not be relied upon as such. Nano may review user interactions, including AI interactions, to improve service quality, ensure program integrity, maintain security, and comply with legal obligations.
User inputs and related interaction data may also be used by Nano to improve, train, and refine Nano's AI systems and related features. Where third-party AI providers are used, processing is performed under contractual data protection obligations and not for the provider's independent commercial purposes unless expressly disclosed.
3. Information We Collect
We collect personal information that you provide directly or that is generated through your use of the services, including:
- Identifiers (such as name, email address, and phone number if you choose to provide it).
- Text messaging information (if you opt in), such as opt-in/opt-out status, message content, message delivery status, and related timestamps.
- Account credentials
- Health-related data (including weight, body measurements, goals, food logs, and activity logs)
- User submitted chat conversations
- Photos and videos submitted by users
- Usage information and device data
- Payment information (processed through third-party payment providers)
We collect only information reasonably necessary to provide and improve our services.
4. How We Use Information
We use personal information to:
- Operate and deliver Nano programs
- Communications: To communicate with you about your account and program participation, including by email and in-app notifications, and by SMS/MMS if you opt in.
- Personalize user experiences
- Provide AI-assisted guidance
- Verify outcomes and program participation
- Sponsorship Opportunities (if you opt in): to facilitate potential sponsorship opportunities and introductions to third-party Sponsors.
- Process payments
- Maintain security and prevent fraud
- Improve services and develop new features
- Community development, marketing and promotional campaigns
- Comply with legal obligations
Nano may use, reproduce, modify, display, distribute, and otherwise use photos, videos, testimonials, and other User Content (as defined in the Nano End User License Agreement) within the Services and for business purposes, including product features, improvement, analytics, promotion, marketing, advertising, and training artificial intelligence systems, consistent with the rights granted in the End User License Agreement.
If content is displayed in publicly accessible formats (such as testimonials, promotional materials, or highlight features), it may be visible to other users or to the general public.
5. Deidentified and Aggregated Data
We may create, use, analyze, license, and commercialize deidentified or aggregated information derived from user data for analytics, research, benchmarking, trend reporting, product development, and other lawful business purposes.
Deidentified information does not identify and cannot reasonably be linked to an individual, household, or device.
We implement technical, administrative, and contractual safeguards designed to prevent reidentification and will not attempt to reidentify deidentified information except as permitted by law.
Deidentified information is not personal information under applicable law.
6. Sharing of Information
6.1
We may share personal information with service providers and contractors who process information on our behalf and are contractually restricted from using it for purposes other than providing services to us. These service providers may include:
- Cloud hosting and infrastructure providers
- Messaging providers (SMS/MMS)
- Payment processors
- Analytics providers
- AI infrastructure and model providers
- Security and fraud prevention providers
- Customer support tools
SMS/MMS Communications. If you provide your phone number and opt in to receive SMS/MMS messages from Nano, we may collect and use your phone number and messaging information (such as opt-in/opt-out status and message delivery information) to send messages and to honor your preferences (including opt-out requests). We may share this information with our messaging service providers and mobile carriers solely to deliver messages and administer the program. Mobile opt-in data will not be shared with third parties or affiliates for their own marketing or promotional purposes. You can opt out at any time by replying STOP (or as otherwise described at enrollment).
Service providers are required to implement reasonable security safeguards and to process personal information only in accordance with our instructions and applicable law. We do not sell personal information and do not share personal information for cross-context behavioral advertising. We do not knowingly collect or disclose personal information from children under 16 years of age without appropriate consent. We may also disclose information if required by law, court order, or governmental request, or where we believe such disclosure is necessary to protect the rights, safety, or integrity of us, our users, or others.
6.2. Sponsors
If you opt in to Sponsorship Opportunities, we may share certain personal information and User Content you upload or submit through Nano (including potentially photos and videos) and related profile/program participation information with potential Sponsors so they can evaluate and contact you about sponsorship opportunities. Sponsors are independent third parties, and their use of information is governed by their own terms and privacy policies. You can withdraw from Sponsorship Opportunities via email to support@nano.com at any time (which stops future sharing but does not recall information already shared).
7. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including operational, legal, accounting, and reporting requirements.
Retention periods vary depending on the nature of the information and applicable law. Deidentified information may be retained longer or indefinitely for research, analytics, and benchmarking purposes.
8. Data Transfers & Jurisdiction
If personal information is transferred outside your region, we implement appropriate legal safeguards, including Standard Contractual Clauses where required.
This Policy is governed by Nevada law and subject to the arbitration provisions set forth in the Nano End User License Agreement.
9. Your Rights
Subject to applicable law, users may request:
- Access to their personal information
- Correction of inaccurate information
- Deletion of personal information
Deletion requests do not apply to User Content that has been incorporated into aggregated or deidentified materials, or where Nano retains rights under the End User License Agreement, to the extent permitted by law.

10. California Privacy Rights (CCPA/CPRA)
California residents have rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to:
- Know the categories of personal information collected
- Access personal information
- Request deletion
- Request correction
- Limit use of sensitive personal information where applicable
- Not be discriminated against for exercising privacy rights
Nano does not sell personal information and does not share personal information for cross-context behavioral advertising.
Nano collects sensitive personal information (including health-related data and body measurements) solely for permitted business purposes and does not use such information beyond those purposes, except as you direct or authorize through the Services (for example, by submitting User Content under the End User License Agreement or opting in to Sponsorship Opportunities), in each case subject to applicable law.

11. Updates
We may revise this Policy periodically. If we make material changes, we will provide additional notice as required by law. Continued use of the services constitutes acceptance of the updated Policy.
