Nano.com 2X Money Back Guarantee Policy
Effective Date: February 14, 2026
The Nano.com 2X Money Back Guarantee Policy ("Guarantee Policy", the "Guarantee", "2x Money Back Guarantee", "2x Guarantee", "Guarantee") govern eligibility for and payment of Nano's 2X Money Back Guarantee. This Guarantee Policy is incorporated by reference into the Nano End User License Agreement ("EULA").
Capitalized terms not defined here have the meanings given in the EULA.
By starting a Sprint (defined below), you agree to this Guarantee Policy.
1. Nature of the Guarantee
The Guarantee is a promotional incentive offered as part of Nano's paid membership program.
The Guarantee:
- Is not insurance
- Is not a wagering or gambling contract
- Is not an investment product
- Does not create any fiduciary obligation
- Nano does not guarantee that any member will achieve any specific outcome.
- Individual results vary.
2. Membership Requirement and SMS Requirement
An active paid Nano membership is required to start and participate in a Sprint, and for 2X Guarantee eligibility.
Membership is not required at the time of claim submission or payout, provided:
- The Sprint was initiated and completed while membership was active;
- All eligibility criteria were satisfied during the Sprint and the period of active membership; and
- The Claim is timely submitted within the Claim Window.
If membership is cancelled or lapses for non-payment during an active Sprint, the Sprint automatically terminates as of the effective cancellation or lapse date, and your 2X Guarantee eligibility ends.
You must opt in to receiving SMS/MMS text messages, app notifications, and email notifications to be eligible for the 2X Money Back Guarantee.
This Guarantee does not replace or modify any statutory cancellation or refund rights required under applicable law, including California's Automatic Renewal Law.
3. Sprint Definition
Every Nano Sprint ("Sprint") is a goal-oriented program which includes:
- A fixed start date
- A fixed end date
- A defined success outcome
- Required actions
- Required proof submissions
Success criteria are defined solely within the Nano platform at the time the Sprint begins and may include objective and/or measurable benchmarks. External interpretations of "success" do not control eligibility.
At the time a Sprint is created, the member must select or define a goal that is reasonable, measurable, and achievable within the Sprint duration, and Nano tools, AI systems, or coaches may assist in establishing appropriate goals and action plans; Nano may decline or require modification of goals that are unrealistic, unsafe, inconsistent with the Sprint duration, or otherwise inconsistent with the purpose of the program.
A Sprint may only remain active while membership remains active.
4. Additional Eligibility Requirements
A Sprint is eligible for the Guarantee only if all of the following are satisfied:
4.1 Sprint Length: Only Sprints that are 90 days or fewer are eligible.
4.2 One Guaranteed Sprint at a Time: Only one active Guarantee-eligible Sprint may run at a time per member.
4.3 Good Faith Participation: Members must participate in Sprints in good faith with genuine intent to achieve the defined outcome. Patterns of minimal threshold compliance or intentional underperformance, manipulation of required actions, artificial activity generation, or strategic conduct designed primarily to trigger a payout may disqualify eligibility.
4.4 Qualified Failure: The Sprint must result in a Qualified Failure as defined below.
5. Failure Qualification Requirements for the Guarantee
A Sprint qualifies for the Guarantee ("Qualified Failure") only if all of the following are true:
- At least 90% of required actions were completed.
- At least 90% of required proof was submitted on time.
- All required proof was valid and approved.
- No Sprint rules were violated.
- Participation was in good faith.
- Final goal was not achieved and failure evidence was provided.
Failure to meet any of these conditions disqualifies eligibility.
Nano may determine that certain required actions or proof submissions are core requirements for the Sprint outcome; failure to complete any such core requirement may disqualify eligibility for the Guarantee regardless of overall completion percentages.
6. Proof Requirements
6.1 Daily Submission Rule
Required proof must be submitted:
- On the same calendar day as the required action
- Before 11:59 PM in the member's registered time zone
- Late submissions do not count.
6.2 Proof Standards
Submitted proof must match the proof type specified by Nano.
Proof may be:
- Automatically verified
- Manually reviewed
- Subject to audit
Nano may request clarification or additional proof at any time.
6.3 Additional Proof for External Outcomes
If success depends on third-party decisions or external factors (including hiring decisions, admissions decisions, dating outcomes, business deals, or similar), Nano may require additional documentation following claim submission.
Nano does not guarantee that third-party outcomes will occur.
6.4 Invalid or Rejected Proof
Repeated invalid submissions may disqualify eligibility. For example, three or more rejected proofs may result in loss of Guarantee eligibility.
7. Goal Lock, Sprint Changes, and Lazy Tokens
7.1 Goals are locked upon Sprint formation and Sprint parameters cannot be modified retroactively. Minor prospective changes may be permitted. Major scope changes may require cancellation and initiation of a new Sprint. If a new Sprint is initiated:
- The Guarantee Payout Base and timeline resets
- New proof and action requirements will apply
7.2 Nano may, in its sole and absolute discretion, issue "Lazy Tokens" that satisfy one proof submission for one day under this Guarantee. Lazy Tokens must be used by you in Nano to count as proof; unused Lazy Tokens will not count as proof. Lazy Tokens terminate when membership terminates.
Nano may grant, withhold, condition, revoke (prior to use), modify, limit, or discontinue Lazy Tokens at any time for any reason. Lazy Tokens are discretionary benefits and do not create any vested right, expectation, waiver, or amendment of this Guarantee.
8. Nano Success Assessment and Recalibration
Nano may monitor participation data, action completion rates, and proof submission patterns during a Sprint. If Nano observes repeated missed required actions, missed proof submissions, or performance trends indicating that the defined Sprint outcome is unlikely to be achieved, Nano may recommend a goal recalibration to improve the likelihood of success. Recalibration may include modification of the defined outcome, required actions, proof requirements, or Sprint duration. Any recalibration applies prospectively only and does not retroactively modify previously missed requirements.
Recalibration is optional. However, continued failure to complete required actions or submit required proof may result in ineligibility for the Guarantee under Section 5 if the applicable thresholds are not satisfied.
If a recalibration results in the creation of a new Sprint, the prior Sprint will immediately close, and a new Sprint will begin with a new start date, new end (target) date, new criteria, and a reset Payout Base attributable only to the new Sprint period.
Nano evaluates participation and recalibration decisions in good faith in accordance with these published criteria at its sole discretion and all decisions are final.
9. Payout Base Calculation
The Payout Base equals the actual net membership fees paid and attributable to the Sprint period.
9.1 Pro-ration Method
For simplicity:
- Monthly plans use a 30-day month
- Annual plans use a 365-day year
Example:
A 45-day Sprint under a $20/month plan:
$20 ÷ 30 = $0.67/day
$0.67 × 45 days = $30 Payout Base
$30 × 2 = $60 Payout (2x Money Back Guarantee)
9.2 Exclusions
The following are excluded from the Payout Base:
- Taxes
- Promotional credits
- Discounts
- Chargebacks
- Reversals
- Refunded amounts
- Disputed or unpaid balances
10. Guarantee Payout
All monetary amounts payable under this Guarantee will be calculated and paid in U.S. dollars and rounded to the nearest cent.
If a Sprint ends in a Qualified Failure: Nano will pay 2x the Payout Base in cash.
The 2X payout is the sole and exclusive remedy related to any Guarantee claim. No additional statutory, consequential, punitive, or other damages are available in connection with a Guarantee claim. Issuance of a payout does not constitute an admission of liability or wrongdoing by Nano.
11. Claim Review, Escalation, and Mandatory Mediation
11.1 Claim Window
Claims must be submitted within 7 calendar days following the Sprint end date (the "Claim Window"). Late claims are ineligible.
11.2 Exclusive Form of Submission
All Guarantee claims must be submitted exclusively by contacting us via resolutions@nano.com within the Claim Window. A claim is not considered submitted until all required information and documentation have been provided, including substantiated evidence of the Sprint resulting in failure. Nano will review participation data, proof submissions, account history, submitted evidence of Sprint failure, and any additional documentation reasonably necessary to evaluate eligibility. Nano will issue a written eligibility determination within thirty (30) days after receipt of a complete claim submission. If additional documentation is requested, the review period is paused until such documentation is received. Incomplete claims may be rejected without substantive review.
11.3 Supplemental Information Requirement
Nano may request supplemental documentation or clarification reasonably necessary to evaluate eligibility. The member must provide requested information within three (3) calendar days. Failure to timely provide requested documentation voids the claim. Repeated incomplete or deficient submissions may result in permanent ineligibility for the Guarantee for that Sprint.
11.4 Internal Appeal
If a claim is denied, the member may submit one (1) written appeal within five (5) calendar days of the denial. The appeal must:
- Identify specific factual errors in the determination
- Reference relevant participation data or proof
- Be submitted to resolutions@nano.com
No new evidence may be submitted on appeal unless specifically requested by Nano. Nano will issue a written appeal determination within thirty (30) days. The appeal determination constitutes Nano's final internal program decision.
11.5 Mandatory Notice of Dispute
Before initiating mediation, arbitration, small claims court, or any other legal proceeding relating to the Guarantee, the member must submit a written Notice of Dispute to legal@nano.com. The Notice must include:
- Full legal name
- Account email address
- Sprint details
- The specific basis of the dispute
- The amount claimed
- A statement confirming completion of Sections 11.1 through 11.4
Nano and the member agree to engage in good-faith efforts to resolve the dispute for sixty (60) days following receipt of a complete Notice of Dispute. No mediation or arbitration demand may be filed until this sixty (60) day period has expired. Failure to submit a compliant Notice of Dispute renders the claim procedurally defective and ineligible for payout.
11.6 Mandatory Mediation (Condition of Eligibility)
If a dispute remains unresolved after completion of the Notice of Dispute process, the dispute must be submitted to non-binding confidential mediation as a condition precedent to eligibility for any 2X Guarantee payout. Mediation shall:
- Be conducted virtually unless otherwise agreed
- Be administered by a neutral mediator selected by Nano
- Be scheduled within sixty (60) days of written mediation request
- Be limited to a single session of up to four (4) hours
- Be conducted in good faith by both parties
Nano will pay the mediator's administrative fees for one (1) mediation session.
Each party shall bear its own attorney's fees and costs unless otherwise required by applicable law.
If mediation does not resolve the dispute, further dispute resolution shall be governed exclusively by the Nano EULA. Failure to participate in mediation in good faith permanently voids eligibility for payout.
11.7 Individual Resolution Only
All Guarantee claims must be pursued on an individual basis. No claim may be joined, consolidated, coordinated, or brought on behalf of multiple members. Each mediation or subsequent proceeding must relate solely to an individual member's Sprint.
11.8 Strict Compliance Required
Strict compliance with all procedures, deadlines, documentation requirements, notice requirements, and mediation obligations set forth in this Section 11 is a material condition of eligibility for any 2X Guarantee payout. Failure to comply with any procedural requirement permanently bars eligibility for payout.
11.9 Exclusive Remedy
If a Sprint qualifies as a Qualified Failure, the 2X payout described in Section 10 is the sole and exclusive remedy related to any Guarantee claim. No additional statutory, consequential, incidental, punitive, or other damages are available in connection with a Guarantee claim except as required by applicable law.
12. Payout Cap & Disqualification
A maximum of one 2X Guarantee payout is permitted per member within any rolling twelve (12) month period.
Disqualification, for any reason, from the 2x Money Back Guarantee does not cancel membership or stop payment obligations.
13. Fraud and Abuse Protection
The Guarantee is void in cases of fraud, abuse, or manipulation, including but not limited to:
- Duplicate accounts
- Falsified proof
- Manipulated activity logs
- Coordinated system exploitation
- Artificial activity or proof generation
- Irregular account behavior
Nano frequently audits proofs and claims.
Nano may:
- Deny claims
- Suspend payout
- Terminate membership
- Permanently ban accounts
Nano's determination of fraud, abuse, or manipulation may be based on platform analytics, participation patterns, or other objective indicators, and such determinations are final absent clear factual error demonstrated through the Section 11 appeal process.
14. Cooperation and Verification
As a condition of payout, Nano may require:
- Identity verification
- Confirmation of account ownership
- Reasonable documentation
- Written certification of good faith participation
Failure to cooperate voids eligibility.
15. Payout Delivery
If approved: Payment will be deposited to the original payment method within 30 days of claim approval. Nano is not responsible for delays caused by payment processors or financial institutions.
16. Post-Payout Platform Access
At Nano's discretion, a member may be restricted or permanently banned from the Nano platform following a successful 2X Money Back Guarantee payout. This limitation is intended to preserve the integrity of the Guarantee program and prevent repeated exploitation or participation patterns inconsistent with the purpose of the Guarantee.
Members may not make public statements that mischaracterize the Guarantee, including suggesting that payouts are typical, automatic, easy to obtain, or intended as a source of profit. Nano reserves the right to take immediate legal action and/or corrective action, including content removal requests, account restriction, termination, and lawsuits, if public statements materially misrepresent the structure or intent of the Guarantee.
17. Program Authority, Final Determinations, and Exhaustion of Procedures
Nano evaluates participation and recalibration decisions in good faith in accordance with these published criteria at its sole discretion and all decisions are final.
The 2X Guarantee is a limited promotional program subject to defined eligibility criteria and structured review procedures. Nano administers and interprets the Guarantee in good faith using a reasonable interpretation of the published criteria, participation data, proof submissions, and account activity.
All determinations regarding: Sprint eligibility, Qualified Failure, completion thresholds, proof validity, fraud, abuse, or manipulation, payout calculation, and procedural compliance are made pursuant to these Guarantee Policy and the Nano platform records.
Nano's internal appeal determination under Section 11.4 constitutes the final internal program decision. Strict compliance with all procedures set forth in Section 11 — including claim submission requirements, documentation deadlines, Notice of Dispute requirements, and mandatory mediation — is a material condition precedent to eligibility for any payout. Failure to strictly comply permanently bars eligibility for payout. The 2X payout described in Section 10 is the sole and exclusive remedy relating to any Guarantee claim.
The Guarantee does not create:
- Any independent contractual damages remedy
- Any entitlement to consequential, incidental, statutory, or punitive damages
- Any right to specific performance
- Any fiduciary or advisory obligation
Except where prohibited by applicable law, no claim relating to the Guarantee may be pursued unless the member has exhausted all procedures set forth in Section 11. If a dispute proceeds beyond mediation, it shall be governed exclusively by the dispute resolution provisions set forth in the Nano EULA. Nothing in this Section limits any non-waivable statutory rights.
18. Modifications
Nano may modify these Guarantee Policy prospectively. Changes do not apply retroactively to Sprints already in progress.
